I'm doing some Paypal work using Ruby on Rails, with test accounts in the 'sandbox', the area that duplicates the functionality of Paypal but without transfering any actual funds. I'm working on getting the authorization & capture process going, but the 'capture' failes because there is some temporary hold put on the authorized transfers (even thos they do no deal with real money). I've email Paypal tech support and I've done web searchs, but to no avail.

Any ideas?

A jury of Jammie Thomas-Rasset's peers just levied a $1,920,000 fine against the young mother of 4 for sharing 24 songs on Kazaa.

The defendant, and others, are basically saying... "Good luck collecting it... you can't get blood from a turnip."
They (the RIAA) don't have to collect it. That wasn't the point. They made an example by publicly "executing" her.

They (the RIAA) don't have to collect it. That wasn't the point. They made an example by publicly "executing" her.

The RIAA just showed every "tweenie," teen, pirate and casual illegal downloader in the country that they will subpoena every IP address, data record, ISP account and bank statement available to build a federal case against any and all individuals, no matter how "small" and "off-the-radar" they are.

This was the legal equivalent of a town-square public-hanging.

Let's break this down point for point...

A. This wasn't about money for the RIAA. It wasn't about settlements, dollars, statutory damages pursuant 17 USC 504 or recovering anything for the industry. It was about sending a cold, clear message to everyone who thinks that "Pirate Bay Rules!" and that they can download anything they want, because they'll "never get caught."

B. It was the defense's tactics that caused the RIAA to make this issue so public. My group hears the "it really wasn't me at my computer" defense, everyday. That doesn't fly, and the RIAA found a very, very public forum to prove this to the world.

C. The "What is Kazaa? What is Internet? What is keyboard? I love lamp." defense. Garbage.

D. "There will be another trial... She'll keep fighting... bla bla bla..." Why? She's lost twice. She pirated music. The first time, a jury of her peers said she owed $220,000. This time a jury of her peers said that she owed $1.9 Million. The next trial, they'll probably make her wear a "scarlet circle-C."

I don't understand what anti-RIAA proponents are waiting for... God? The Copyright-Fairy? ...To part the clouds and say "It's OK, my children, to steal all the music, movies and software you want... go forth... steal everything... live long and prosper...Go Pirate Bay!...Go Packers!..." Really? I mean... Really?

It's... not... going... to... happen.

Pirate Bay guys - jailed
Kazaa Girl - lost two trials and is now owned by RIAA
ISP's - strong-armed into bending to the RIAA's will

More fun stuff...

This judgment will follow her forever. Recent court rulings (known as "case law") have clearly established that willful copyright infringement is nondischargeable in bankruptcy. Which means, anytime she gets a paycheck, alimony payment or birthday-card from grandma... the RIAA will be there to garnish it. A $1,920,000 judgment will appear on her credit for the rest of her life. Which means... no car loan... no house loan... and probably no job above that of "burger flipper."

Let me be perfectly clear... the RIAA literally, and legally owns Ms. Thomas-Rasset.

As for the statement, "You can't squeeze blood from a turnip." True. But you can publicly crush it.
For the record... I am not pro-RIAA, pro-BSA, pro-SIIA, pro-Hollywood nor pro-Big-Software. I believe in (and love) the law. Specifically, copyright law. It's my job. It's my life.

I work, everyday, to help people and companies avoid problems, just like the one Ms. Thomas-Rasset is now facing. The first step is education on what copyright is, and how it works.

Copyright is extremely complex, and very complicated.

Rule 1: If you wait until someone is "knocking on your door" to start worrying about copyright, music files, software licenses, etc... it is too late.
I'm glad to see Opera working to grow, and try new things...

However, from what I am reading about this new product... nothing about what they're doing sounds good.

As I understand it, Opera Unite turns your desktop into a webserver, and uses Opera's infrastructure to proxy-route other users, to that desktop-webserver.

The security, bandwidth and legal considerations of this idea are absolutely terrifying.

Sadien, Inc's core consulting practice focuses on technology risk, liability and management. Thus, we deal with these very issues, everyday.

Turning desktops into P2P webservers is a horrible, horrible idea.

A. It creates multiple points of access, and failure... to data... to personal information... to financial records... to your local network... to copyrighted material... the list is huge.

B. It, by design, decentralizes virtually all of the security and policy restrictions in a production environment.

C. From what I gather... this will make bandwidth issues worse, not better. How can Opera possibly believe it's better to have 100's users accessing a single desktop, than it would be to upload the files in question to another, dedicated server? That makes no sense.

Maybe I'm misunderstanding what Opera is proposing. My first reaction to their release is...

"Opera Unite will never, ever be on any machine we control, ever."
Piracy is bad. No question about it. (And before all of the Pro-Pirate-Bay-Copyright-Sucks-I-Dont-Wanna-Pay-For-Stuff people start throwing a tantrum over that statement, I believe the bigger question is, "What is an appropriate definition of piracy?")

Copyright holders should have an absolute right to protect their content, and distribute it as they see fit. If they wish to charge for it, great. If they wish to give it away for free, that's great too.

The point is, it should be the copyright holder's choice. Period. The exact same way that if you go to work... you get paid. If you donate your time to a cause... it's charity.

Forcing an individual or entity to GIVE AWAY their work-product, is slavery. And, I mean that literally, by definition.

If you have a 25 year old man. And you force him work for 100's of hours to create a "widget"... then gave it away to the public for free... with no compensation to the young man... every special-interest group on the planet would be screaming the words "slavery" and "human rights violations" on behalf of the young workman.

Yet, when that "young man" is a multi-billion dollar content provider... the entire mood shifts to "Screw 'em. They've got the money."

Is this fair?

Please understand, my group is NOT, ABSOLUTELY NOT, an advocate for "big-software," "Hollywood," or any other commercial group. We believe those groups can be unfair, unethical, and use heavy-handed tactics to push their own agenda.

Our opinion is that content providers and content users should co-exist in a mutually beneficial, peaceful relationship.

Which brings me back to my original premise, are we losing something in translation on this topic?

I mean, they're called "The Pirate Party." The American definition of "piracy," is "illegal theft."

It stands to reason that people (specifically Americans) might question a "Piracy Party" being elected to any office. They same way we would question political parties named "The Kitten Kickers" or "The Grandma Haters."

Did the EU just fill a political seat with a known, willful criminal element? Or are we missing something here?
